Cancellation Policies:
Cancellations made more than 60 days prior to your arrival date will receive a full refund MINUS the 5% processing fee. Cancellations made 30-60 days prior to your check in date will receive a 50% refund, minus the processing fee.
Reservation Prices do not Include: Expenses and items not mentioned, including, but not limited to: transportation, tips for personal services, meals, insurance, telephone calls and other items of a personal nature.
Responsibility:
Tenant hereby assumes all risk of damage to any and all personal property of Landlord and Tenant, including household furniture and goods during such use and occupancy. Tenant hereby assumes any and all risks associated with the foregoing and agrees to hold Landlord harmless from and indemnify Landlord against the same.

THIS IS A VACATION RENTAL AGREEMENT UNDER THE NORTH CAROLINA VACATION RENTAL ACT. THE RIGHTS AND OBLIGATIONS OF THE PARTIES TO THIS AGREEMENT ARE DEFINED BY LAW AND INCLUDE UNIQUE PROVISIONS PERMITTING THE DISBURSEMENT OF RENT PRIOR TO TENANCY AND EXPEDITED EVICTION OF TENANTS. YOUR SIGNATURE ON THIS AGREEMENT, OR PAYMENT OF MONEY OR TAKING POSSESSION OF THE PROPERTY AFTER RECEIPT OF THE AGREEMENT, IS EVIDENCE OF YOUR ACCEPTANCE OF THE AGREEMENT AND YOUR INTENT TO USE THIS PROPERTY FOR A VACATION RENTAL.

Agent, as agent of the owner, hereby rents to Tenant, and Tenant hereby rents from Agent, the vacation property described below (referred to hereafter as the “Premises”) on the terms contained in this Agreement.

IMPORTANT INFORMATION PLEASE READ THOROUGHLY:
Check-In: At 4:00 PM or after on the day of arrival, please proceed your rental. You will receive an email 7 days prior to check in with your rental address and a code for the door. This code will not work prior to 4:00PM on your arrival date or after 10:00AM on your departure date.
Check Out: 10:00 AM or earlier on the date of departure. Please exercise courtesy to the arriving guest by adhering to the check-out time. You may be charged a fee for check out times later than 10:00 AM. Your lock code will not work after 10:00 AM, therefore you will not have access to your unit.
What to Bring: We suggest bringing paper towels, toilet tissue, kitchen trash bags, dish detergent, bar soap, shampoo, toiletries, laundry detergent (if your unit has a washer/dryer), hair dryers, food wrap, seasonings, board games, books, sun screen, medications and first aid, boogie boards, beach chairs, beach umbrella, etc. Some units may have a few of these items, but it is not guaranteed. Kitchen utensils, cookware, dishes, and small appliances are provided according to the homeowner’s discretion.
Linens: All reservations include linens (bed sheets and bath towels). Towels are not to be used on the beach, and guests will be charged for any missing linens.
Payment Schedule: Unless booking on VRBO or Airbnb (which may have different payment terms) A 50% deposit of your total amount is due at booking. The remainder of your total is due 30 days before your arrival date. If you are unable to make your second payment your reservation will be cancelled.
CANCELLATIONS AND CHANGES: The processing fee (credit card fee) of 5% of the total reservation is NON refundable for any reason regardless of when time of cancellation occurs. Unless booking on VRBO or Airbnb (which may have different cancellation terms) You may cancel your reservation at any time by calling or emailing us. Cancellations made more than 60 days prior to your arrival date will receive a full refund minus the 5% processing fee. Cancellations made 30-60 days prior to your check in date will receive a 50% refund minus your processing fee. Changes to dates and/or properties are treated the same as cancellations.
Travel insurance through Rental Guardian is available for purchase at the time of your reservation. You may add this to your reservation any time before you make your final payment for 6.95% of your full payment. Hurricane Policy: In the event of a mandatory or voluntary ordered evacuation all guests must evacuate immediately. Refunds are not given for natural disasters; however, trip interruption insurance is available to purchase at the time of your reservation, and may be added any time before your final payment is due. This offers coverage for medical emergencies, death in the family, and natural disasters such as hurricanes. A full description of the coverage can be found at https:// rentalguardian.com/
*If State or local authorities order an evacuation of an area that includes the Premises, Tenant shall comply with the order. Upon compliance, Tenant will be entitled to a refund of the prorated rent for each night that Tenant is unable to occupy the Premises because of the order. However, Tenant will not be entitled to a refund if, prior to taking possession of the Premises: (i) Tenant refused insurance offered by Agent that would have compensated Tenant for losses or damages resulting from loss of use of the Premises due to a mandatory evacuation order, or (ii) Tenant purchased such insurance from Agent.
Damage Waiver: As part of your rental reservation, you have paid a non refundable damage waiver fee. You have paid this fee in lieu of a providing a refundable security deposit. The damage waiver fee releases you from responsibility for any accidental damage that may occur to the property during your rental period, up to $1,500 in value (including materials and labor costs). Intentional damages, damages caused by gross negligence and/or removal of items included in the rental that go missing will not be covered by this waiver. Expenses for damages that will not be covered may include, but are not limited to: costs to replace missing items, extra cleaning charges due to excessively dirty or sandy conditions, smoking in the unit, pet related damages, intentional acts or neglect, and any damage that occurs due to violation of the lease agreement.
Lost We assume no responsibility for the loss, damage, or theft of any of your personal effects. Reasonable effort will be made to contact the Guest for return. There will be a $25.00 handling charge plus shipping costs for any found items returned at Guest’s request. Management shall not be held liable for condition of said items. Any accidental damages in excess of $1,500 AND/OR any intentional damage or theft, shall be the responsibility of the renter and will be billed to renter. If we have your credit card on file, then these excess expenses will automatically be charged to your credit card.
SHIPPING: You may ship directly to the home that you are staying in using Fedex or UPS while your are in the home, however we can not guarantee delivery or security of the package. This will be up to the shipping client and the shipping receiver to arrange. **We are not responsible for any lost, damaged or delayed deliveries. Returning late deliveries after a guest has left will incur an additional fee, plus cost of shipping.
Departure Cleaning: Cleaning service is mandatory on all vacation rentals. This is how we ensure that each unit is property cleaned and sanitized before your arrival. An additional cleaning charge will be added to your property if the property is left excessively dirty/sandy, or the following requirements are not met. Prior to your departure, you are required to (1) carry out all garbage, (2) secure all doors and windows, (3) remove all items from the freezer and refrigerator, (4) strip the beds of sheets and pillow cases and place them on the floor beside the bed, do not remove mattress covers or pillow shams, please blankets and comforters on the beds, place used towels on the floors in the bathrooms, (5) run the dishwasher and return items to their original place, (6) clean grill and grill utensils and empty grease trap.
Upon Arrival: Please inspect your unit and notify us immediately of any problems or issues. Every effort will be made to ensure that your unit is clean and undamaged before your arrival. Please notify us immediately of any items that need attention to ensure these problems are taken care of immediately and that you will not be held responsible.
Age Requirement: You must be at least 28 years of age to book any properties managed by Brunswick Vacation Rentals. If you are traveling with guests unrelated to you, the minimum average age of all guests must be older than or equal to 28 years old.
Pet Policy: Absolutely no pets are allowed on any property, unless specifically allowed for in the description of that individual property. If you are bringing your pet to a pet friendly property you must pay the pet fee when booking. Any pet found in or around a property that is not notated as “pet friendly” or not included in the booking price, will result in a charge of up to $500, immediate eviction and forfeiture of all rents. Any and all damages that result will also be charged to the credit card on file.
Elevator: If home is equipped with an Elevator, please read and carefully follow instructions and follow all rules before operating. You are responsible for all costs for damages caused to the elevator and elevator equipment due to negligence. The management and property owners are not liable for any injuries or death caused by elevator misuse.
Smoking: Smoking is not permitted in or on any rental at any time. There will be a $500 fine for any evidence of smoking inside a rental or on the property. No illegal substances are allowed in the rental, and minors should not be in possession of alcohol. Violations will result in eviction from the property and no refunds will be issued.
Noise Ordinance: We have a strict noise ordinance that must be followed. No loud noises, music, load vehicles are allowed between the hours of 10:00 pm and 7:00 am. Please note if the these are followed you can be fined and asked to vacate the property. Terms include a No Tolerance Policy regarding excessive noise, parties, or disturbing neighbors. Please make sure you are comfortable with our Terms as they are strictly enforced.
Pool / Spa Rules: If rental has a pool or spa, please follow all rules: no glass, no diving, no running, no food or drink in the pool, do not tamper with pool or spa equipment, no jumping from balconies, swim at your own risk. The management and property owners are not liable for any injuries or death due to pool / spa misuse.
Lost Parking Passes / Keys: For security reasons, there will be a $50 charge for all parking passes not left in the notebook in the unit at departure. There will be a $100 charge for any lost key fobs. There will also be a charge for any gate passes, pool passes, pool keys and/or storage keys not left in the notebook.
TV / Cable / Internet: These amenities are furnished by the owner of the property, and their functionality is not guaranteed. The availability and level of service are determined by the homeowner, and Brunswick Vacation Rentals will not make changes to service or contact homeowners to make changes to services. No refund shall be given for number of devices, outages, content, or lack of content or personal preferences with regard to cable/internet/satellite service. Services are provided as a convenience only, and are not integral to this agreement. No refund shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to service.
Exterior Cameras: Please be aware that there are exterior cameras on the premises directed toward the parking areas and/or entrances for added security and peace of mind.
Furnishings & Cleaning: Every property is equipped with basic housekeeping items such as pillows, blankets, furniture, kitchen appliances, pots, pans, dishes, glasses, silverware, and lawn or deck furniture. The condition of the property varies depending on the age and care by the individual owner. Each rental unit is privately owned, and reflects each owner’s personal tastes. Each tenant is expected to use the property as if it were their own, and to leave it undamaged. Specific cleaning requirements are as follows: all kitchen, cooking, eating and drinking utensils/equipment are to be cleaned and stored in their proper place. All trash must be removed from the property and placed into the proper outdoor garbage cans or dumpster site. Failure to clean property as described will result in an additional cleaning charge.
Absolutely No Events or House Parties: Any evidence or reports of parties or events including but not limited to weddings, receptions, multi-house parties, etc.. will result in a $500 fee and IMMEDIATE eviction from the property. This
$500 fee does not include any additional cleaning or damage fees that we may charge. Any damages or stolen items will be reported to the authorities.
Pools/Exercise Facilities, Etc.: Because amenities are governed and maintained by the HOA of each individual property Brunswick Vacation Rentals cannot assume any responsibility for condition or availability of these amenities. Please keep in mind that HOA’s use the off-season months to perform improvements or reconditioning of the property and/or amenities.
Problem Resolution: If you should discover that your unit has not been cleaned or has damages, please report it to us immediately and we will make all efforts to resolve the problem. Check out time is NOT the time to inform us about problems. We cannot issue refunds for mechanical breakdowns. Brunswick Vacation Rentals personnel or representatives shall have the right to enter the property at reasonable hours to make timely repairs or inspections. If a service call is made and entry refused, the renter will be held liable for service call fees. Guest agrees that Air conditioning shall not be set below 72 degrees and heat shall not be set above 78, and that the fan setting shall be “Auto”. Doors and windows shall be closed when either heat or air conditioning is in operation. There are no refunds for lack of, or malfunctioning HVAC units.
Failure of a System: In the event the rental unit sustains a failure of a system, including but not limited to water, sewer, septic, electrical, gas, plumbing, mechanical, appliances, heat pump, ventilating, pool, hot tub or other system or structural systems, neither the property owner nor the Management shall be liable to Guest for damages, and no refunds will be given for such failures. However, Management will make an effort to promptly repair or replace the failed system or equipment, and in such event, Guest agrees to permit Manager or its service provider to have reasonable access to the property to inspect and make such repairs.
Locked Closets: Most of our property owners maintain a locked area in their unit for their own personal use. These locked areas are not intended for tenants’ use. Tampering with these locks will result in extra repair charges.
Transfer of Property: In the event the Owner is unable to deliver said property to Tenant because of fire, eminent domain, delay in construction, lack or water/ sewer, etc., Brunswick Vacation Rentals reserves the right to transfer reservations to a comparable unit or refund advance prepayment. If Agent is able to relocate Tenant, Tenant agrees to pay the difference in rental amount, or accept a refund of all monies paid to Agent. Tenant further agrees that neither Agent nor Owner shall be responsible for any consequential or secondary damages, including but not limited to, any expense incurred as a result of moving. Every effort will be made to contact customer prior to arrival, and to offer similar, satisfactory accommodations, however, we will not be responsible if customer cannot be reached by contact information given at the time of the reservation. Tenant shall not be issued a refund due to unfavorable weather, maintenance problems, area construction, ready departure, or disruption of utility services (including internet and cable), after occupancy. We cannot be held responsible for circumstances beyond our control. This includes excessive noise from construction or public/private events, wildfire/smoke, weather related interruptions, road closures, lack of snow, frozen pipes, interruption of services and utilities or unexpected appliance breakdown.
Disbursement of Rent and Third Party Fees: Tenant authorizes Agent to disburse up to fifty percent (50%) of the to the owner (or as the owner directs) prior to Tenant's occupancy of the Premises, and the balance of the rent upon the commencement of the tenancy, a material breach of this Agreement by Tenant, or as otherwise permitted under the Vacation Rental Act. Tenant agrees to pay a $25.00 processing fee for any check of Tenant that may be returned by the financial institution due to insufficient funds or because Tenant did not have an account at the financial institution. Tenant also authorizes Agent to disburse prior to Tenant's occupancy of the Premises any fees owed to third parties to pay for any goods, services, or benefits procured by Agent for the benefit of Tenant, including but not limited to any fees set forth herein payable to Agent for reservation, transfer or cancellation of Tenant's tenancy.
Trust Account: Any advance payment made by Tenant shall be deposited in a trust account with First Citizens Bank located at 440 S College Rd, Wilmington, NC 28403. Tenant agrees that any advance payment may be deposited in an interest-bearing trust account and that any interest thereon shall accrue for the benefit of, and shall be paid to, the owner (or as the owner directs) as it accrues and as often as is permitted by the terms of the account.
Tenant Duties: Tenant agrees to comply with all obligations imposed by the Vacation Rental Act on Tenant with respect to maintenance of the Premises, including but not limited to keeping the Premises as clean and safe as the conditions of the Premises permit and causing no unsafe or unsanitary conditions in the common areas and remainder of the Premises that Tenant uses; and notifying Agent in writing of the need of replacement of or repairs to a smoke detector, and replacing the batteries as needed during the tenancy. Tenant agrees not to use the Premises for any activity or purpose that violates any criminal law or governmental regulation and may use the Premises for residential purposes only. Tenant’s breach of any duty contained in this paragraph shall be considered material, and shall result in the termination of Tenant’s tenancy.
Occupancy Limits: Unless otherwise stated, occupancy of the Premises shall be limited to two persons per bedroom, including family, children and Tenant guests. Bedding arrangements in the Premises are portrayed only to illustrate possible sleeping arrangements and may not be taken as a representation of permitted occupancy. Tenant agrees to be responsible for ensuring that maximum permitted occupancy of the Premises is not exceeded during the term of this Agreement, and should contact Agent with any questions regarding permitted occupancy of the Premises.
Agent Duties: Agent agrees to provide the Premises in a fit and habitable condition. If at the time Tenant is to begin occupancy of the Premises, Agent cannot provide the Premises in a fit and habitable condition or substitute a reasonably comparable property in such condition, Agent shall refund to Tenant all payments made by Tenant. Agent shall conduct all brokerage activities in regard to this Agreement without respect to the race, color, religion, sex, national origin, handicap, familial status, sexual orientation or gender identity of any tenant.
Transfer of Premises:
. (a) If the owner voluntarily transfers the Premises, Tenant has the right to enforce this Agreement against the grantee of the
Premises if Tenant's occupancy under this Agreement is to end 180 days or less after the grantee's interest in the Premises is recorded. If Tenant's occupancy is to end more than 180 days after such recordation, Tenant has no right to enforce the terms of this Agreement unless the grantee agrees in writing to honor this Agreement. If the grantee does not honor this Agreement, Tenant is entitled to a refund of all advance rent paid by Tenant (and other fees owed to third parties not already lawfully disbursed). Within 20 days after transfer of the Premises, the grantee or the grantee's agent is
required to: (i) notify Tenant in writing of the transfer of the Premises, the grantee's name and address, and the date the grantee's interest was recorded; and (ii) advise Tenant whether Tenant has the right to occupy the Premises subject to the terms of this Agreement or receive a refund of any payments made by Tenant. However, if the grantee engages Agent to continue managing the Premises after the transfer, the grantee shall have no obligation under (i) or (ii) above if this Agreement must be honored under the Vacation Rental Act or if the grantee agrees in writing to honor this Agreement.
. (b) Upon termination of the owner's interest in the Premises, whether by sale, assignment, death, appointment of a receiver or otherwise, the owner, owner's agent, or real estate agent is required to transfer all advance rent paid by Tenant (and other fees owed to third parties not already lawfully disbursed) to the owner's successor-in-interest within 30 days, and notify
Tenant by mail of such transfer and of the transferee's name and address. However, if Tenant's occupancy under this Agreement is to end more than 180 days after recordation of the interest of the owner's successor-in interest in the Premises, and the successor-in-interest has not agreed to honor this Agreement, all advance rent paid by Tenant (and other fees owed to third parties not already lawfully disbursed) must be transferred to
Tenant within 30 days.
Expedited Eviction: If the tenancy created hereunder is for 30 days or less, the expedited eviction procedures set forth in the Vacation Rental Act will apply. Tenant may be evicted under such procedures if Tenant: (i) holds over in possession after Tenant's tenancy has expired; (ii) commits a material breach of any provision of this Agreement (including any addendum hereto) that according to its terms would result in the termination of Tenant's tenancy; (iii) fails to pay rent as required by this Agreement; or (iv) has obtained possession of the Premises by fraud or misrepresentation.
Indemnification and Hold Harmless; Right of Entry; Assignment: Tenant agrees to indemnify and hold harmless Agent and the owner from and against any liability for personal injury or property damage sustained by any person (including Tenant's guests) as a result of any cause, unless caused by the negligent or willful act of Agent or the owner, or the failure of Agent or the owner to comply with the Vacation Rental Act. Tenant agrees that Agent, the owner or their respective representatives may enter the Premises during reasonable hours to inspect the Premises, to make such repairs, alterations or improvements thereto as Agent or owner may deem appropriate, or to show the Premises to prospective purchasers or tenants. Tenant shall not assign this Agreement or sublet the Premises in whole or part without written permission of Agent.
Governing Law; Venue: The parties agree that this Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina, and that in the event of a dispute, any legal action may only be instituted in the county where the Property is located. |
